    Services:

From provisional waivers to family-sponsored immigration, the immigration lawyers at Leiva Law Firm have the experience and knowledge to handle any and every particular facet of the U.S. immigration system. Click below to explore each of the various immigration services we offer and how Leiva Law Firm can help you achieve your desired immigration status.

    • I-751 Petition for Removal of Conditions

This form is filled out if you are a conditional permanent resident who obtained that status via marriage, and you want to apply to remove the conditions on your permanent resident status or that of your minor children. You must file this petition before your conditional residence expires for any reason.

    • LGBTQ+ Marriage and Fiance(e) Immigration

Same-sex spouses and fiance(e)s of U.S. citizens and Lawful Permanent Residents and their minor children are eligible for the same immigration benefits as opposite-sex spouses even if the country of origin does not recognize the marriage.

    • Marriage-Based Green Card and Fiance(e) Visas

The K-1 nonimmigrant temporary visa is for the foreign citizen fiancé(e) of a U.S. citizen. This visa permits the fiancé(e) to travel to the U.S. and marry his/her U.S. citizen sponsor within 90 days of arrival. A CR-1 or K-3 visa applies to couples who are married, and one person is a U.S. citizen or green card holder and the non-citizen spouse lives abroad. This is commonly called a marriage green card. According to U.S. Citizenship and Immigration Services, the current processing time for a K-1 (fiancé[e]) visa is 13.3 months and 11.9 months for a spousal visa. K-1 visas have about a 25% denial rate, and spousal visas have a 9% denial rate. Leiva Law Firm can help you navigate every step of the process.

    • Marriage Fraud Interview Support

Many K-1 visa applicants have challenges proving an authentic relationship. Other common reasons for denial include failure to meet eligibility requirements, insufficient evidence, and criminal or immigration violations. If you are called for a marriage fraud interview, Leiva Law Firm's experienced immigration lawyers can support you.

    • Provisional Waiver

The I-601A provisional waiver is a request to U.S. Citizenship and Immigration Services to forgive your unlawful presence in the U.S. and allow you to adjust your immigration status to Lawful Permanent Resident based on a family relationship such as marriage. It is used by people who are currently located in the U.S. Without this waiver, you could be placed into deportation proceedings and therefore unable to reenter the U.S.

My husband and I used Scarlett’s services to apply for his green card. We were very pleased with her professionalism, knowledge, and patience when answering our questions. It seemed that the work was divided between Scarlett herself and her assistants, but we found the whole team to be very trustworthy. Scarlett herself was always easy to reach and quick to respond, and she made us feel comfortable throughout the process. Overall the process went very smoothly and we felt confident that we were in good hands. I’d recommend her services to anyone else applying for a green card.
