Marriage-Based Green Card and Fiance(e) Visas
The K-1 nonimmigrant temporary visa is for the foreign citizen fiancé(e) of a U.S. citizen. This visa permits the fiancé(e) to travel to the U.S. and marry his/her U.S. citizen sponsor within 90 days of arrival. A CR-1 or K-3 visa applies to couples who are married, and one person is a U.S. citizen or green card holder and the non-citizen spouse lives abroad. This is commonly called a marriage green card. According to U.S. Citizenship and Immigration Services, the current processing time for a K-1 (fiancé[e]) visa is 13.3 months and 11.9 months for a spousal visa. Provisional Waiver
The I-601A provisional waiver is a request to U.S. Citizenship and Immigration Services to forgive your unlawful presence in the U.S. and allow you to adjust your immigration status to Lawful Permanent Resident based on a family relationship such as marriage. It is used by people who are currently located in the U.S. Without this waiver, you could be placed into deportation proceedings and therefore unable to reenter the U.S.
