How long does the K-1 process take?
Timelines change, but most K-1 cases take somewhere in the range of 8 to 14 months from filing to your fiancé’s arrival in the U.S. We’ll give you a realistic estimate for your specific situation on the free consultation.
Do we have to get married within 90 days of my fiancé arriving?
Yes. The K-1 visa requires you to marry within 90 days of your fiancé’s entry to the U.S. If you don’t, your fiancé will need to depart. We’ll walk you through exactly how to plan around that deadline.
Can my fiancé work once they arrive?
Your fiancé can apply for a work permit (EAD) after arrival, but the timeline usually means it’s faster to apply for the green card first and get the work authorization that comes with Adjustment of Status. We’ll build that plan into your strategy.
What if my fiancé was denied a U.S. visa before?
A prior denial isn’t automatically a dealbreaker, but it has to be addressed directly in your petition. This is one of the most common reasons couples come to us after trying on their own — we’ll tell you honestly whether your case is viable on the free consultation.
